Audu: What Nigerian Constitution Says About Death of a Gov. Candidate

Nigeria - Governorship candidate of the APC in the Kogi elections, Prince Audu Abubakar, yesterday was reported dead before election results were announced.

Here's the provision the Nigerian constitution made pertaining to the issue:

Section 181 of the 199 constitution says: “If a person duly elected as governor dies before taking and subscribing to the oath of Allegiance and oath of office, or is unable for any reason whatsoever to be sworn in, the person elected with him as deputy governor shall be sworn in as governor and he shall nominate a new deputy governor, who shall be appointed by the governor with the approval of a simple majority of the House of Assembly of the state.”

Section 181 (2), on its part, states: “Where the persons duly elected as governor and deputy governor of a state die or are for any reason unable to assume office before the inauguration of the House of Assembly, the Independent National Electoral Commission shall immediately conduct an election for a governor and deputy governor of the state.”

And Section 33 (2) of the Electoral Act 2014 (as amended) says: “If the candidate whose name was submitted to the Commission dies or withdraws from the election, the political party, which nominated the candidate, shall forward to the Commission the name of the aspirant, who scored the second highest number of votes at the primaries as the substitute candidate.”

However the constitution didn't make provisions specially for death of a governorship candidate when elections were declared inconclusive, creating a legal logjam.

There are reports that APC's kogi governorship candidate, Abubakar Audu, has come back to life.

Abubakar Audu had given up the ghost yesterday according to reports, although proof hasn't been obtained.

His burial ceremony was scheduled for today.

According to YNaija, a prophet during the burial ceremony prayed for Audu’s corpse in an attempt to bring him back to life.

Audu’s family members rejected the request, but angry youths broke open the door of where his corpse was kept.

The prophet was forcefully taken into the room by the irate crowd, who joined him in the prayers chanting: Holy Ghost fire’ and ‘Allahu Akbar’.

While the prayers were being said, the grave-diggers were said to have continued with their work.

Not long into the prayers, news spread round the mammoth crowd that Audu has resurrected and wild jubilation broke out.

At the moment, many are celebrating in the streets of Lokoja over the rumoured resurrection, in spite of an absence of veritable proof that Audu is indeed alive.


 

‘Political Assassination’: Kogi Group Calls For Arrest Of Tinubu Over Abubakar Audu’s ‘Murder’



A group by the name, Kogi United Forum has called on the Inspector General of Police to commence immediate investigation into what it described as the suspected assassination of Prince Abubakar Audu a former governor of Kogi State and gubernatorial candidate of the All Progressives Congress (APC) in the November 21, gubernatorial election in Kogi State.

The group in a statement signed by its National President, Tunde Aina is accusing the National Leader of the APC, Asiwaju Bola Ahmed Tinubu of allegedly masterminding the assassination of the late Audu.
